LOS ANGELES ESTATE PLANNING ATTORNEY

What is Living Wills and Advanced Health Care Directives?

A living will, or advanced health care directive, is similar to a power of attorney in that it gives a trusted party authority to act and/or make decisions on your behalf. The difference is that this documents deals with authority over your health and medical treatment decisions. Much too often a person will become bed ridden and/or mentally incapable without having this important document in place. A lack of this documentation can make it extremely difficult for others, even family members, to get medical records and/or make health care decisions on your behalf. A living will states the types of medical treatments that can and cannot be used on you. Living wills typically cover issues such as artificial life support, resuscitation, organ donation and tube feeding. Having a valid living will in place not only gives you assurance that your decisions will be granted, it also removes the potential burden of decision making off your loved ones because you had planned ahead.

It is essential for all adults, not just the elderly, to have a living will in place because an unexpected illness or accident can happen at any age.

CHAPTER 7 AND 13

Turning to the more common chapters of bankruptcy, Chapters 7 is by far the most common bankruptcy chapter. A Chapters 7, or “fresh start,” bankruptcy is appropriate for individuals in need of help because they cannot afford to pay back their debt.

Chapter 13 bankruptcy is the second most common chapter for individuals. Chapter 13 permits a debtor to repay his or her debts over a period of three to five years. Chapter 13 bankruptcy can also be used to save a vehicle or a home if a debtor has fallen behind on payments. In certain situations, a Chapter 13 bankruptcy can even eliminate the junior mortgages on a property.

WHEN SHOULD YOU HIRE A FORECLOSURE ATTORNEY?

When it comes to foreclosure, hiring an attorney early in the process helps ensure that you have more options available to you than what might be available later in the foreclosure process. For example, the lawyer can help you work out a deal with the lender that will allow you to stay in the home, or, if necessary, fight the foreclosure in court. If you wait too long, however, it might be too late to stop the process.
