Also referred to as a Last Will and Testament, is a legal document in which you give specific instructions to be carried out after your death. For example, you may direct the distribution of your assets (your money and property), and give your choice of guardians for your children. It becomes irrevocable upon death but can be changed any time prior as long as the creator, called a testator, is of sound mind. In your will, you can name:
- Beneficiaries – This is the person(s) or place(s) you wish to receive your assets. You may name almost anyone or any group (family members, friends, spouse, domestic partner or charitable organizations, for example) as a beneficiary. Once this is done you may list specific gifts, such as jewelry or a certain sum of money, to be distributed to specific beneficiaries. Or, you can list all of your assets as a general gift to a specific beneficiary or class of beneficiaries (ie: your children).
- An Executor – This is the person(s) or institution that you will put in charge of collecting and managing your assets; paying any debts, expenses, and taxes that might be due; and then, with the court’s approval, distributing your assets to your beneficiaries according to the instructions in your will. Your executor serves a very important role and has significant responsibilities. It can be a time-consuming job. You should choose your executor carefully.
- A guardian for your minor children – You may nominate a person to be responsible for your child’s or children’s personal care if you and/or your spouse happen to pass on before a minor child turns eighteen. You may also name a guardian—who may or may not be the same person—to be responsible for managing any assets given to a child, until he or she reaches the age of eighteen.
A will is the basic starting point and something that EVERYONE should have in place. Keep in mind that a will is just part of the estate planning process. And whether your estate is large or small, you need a simple will in place to ensure your wishes are carried out, and your family is protected, beyond your lifetime.
